Public Offer Agreement

Terms and definitions «Buyer» is a private person who, when making an order for the purchase and delivery of optical products in accordance with the current price list and catalogs, information about which is posted on the «Internet site», accepts (accepts) this public offer (Offer)  (hereinafter referred to as the Seller) on conclusion of the Contract of retail purchase and sale.
«Acceptance of Offer» — full and unconditional acceptance of the Offer by the Buyer, by filling out the Order in the «online store» and paying it.
«Internet store» — Internet site owned by the Seller having the address www.baby-mood.com,
«Order» means the Buyer’s application for purchase and delivery of optical products, which is agreed on by the both Parties in the information on the name, quantity and quality characteristics of the optical products, the method and the place of its delivery. The list of information to be agreed by the Parties when completing the Order is determined by clause 2 of the Agreement. The Buyer can place an Order on the website of the Internet store or through the manager on the phones indicated on the site, on the terms of this Agreement.
The Buyer, when making an order for the acquisition and delivery of optical products, information about which is placed in the online store, accepts (accepts) this public offer (Offer) of the Seller on the conclusion of the contract of retail sale. The proposal to enter into a Retail Sales Agreement applies to any optical product for the entire period of time while information on the relevant products is posted on the Internet store.
From the moment of payment of the Order executed in accordance with the procedure established in the online store, the Contract of retail purchase and sale is concluded between the Seller and the Buyer as follows:
1. General conditions
1.1. In accordance with Article 437 of the Civil Code of the Ukraine, this Agreement is a public offer and, in the event that the conditions set forth below are met, the Buyer who accepts the offer shall select the Goods and pay for it in accordance with the terms of this Agreement. In accordance with clause , the payment of the Goods by the Buyer is an acceptance of the offer, which is considered equivalent to the conclusion of the Agreement on the conditions set forth in the offer.
1.2. The provisions of the Civil Code of the Russian Federation on retail purchase and sale apply to the relations between the Buyer and the Seller. Law «On Protection of Consumer Rights» of 07.02.1992 No. 2300-1, «Rules for the Sale of Goods by Remote Way,» approved by Resolution of the Government , and other legal acts adopted in accordance with them.
1.3. The Seller reserves the right to unilaterally amend this Agreement.
1.4. The buyer agrees with the terms of this Agreement by clicking the «PAY» button when placing an Order in the online store.
2. Subject of the Agreement
2.1. The Seller undertakes to transfer the optical products (hereinafter — the Goods) to the Buyer in the manner and under the conditions provided for in this Agreement, and the Buyer undertakes to accept the ordered Goods and pay its value in the manner and terms provided for in the Agreement.
3. Order of the Order
3.1. The buyer chooses from the list of goods offered in the Internet-store and by clicking the icon «Place an order» next to each product («Add to cart») goes to the order page.
3.2. On the order page, the Buyer draws up his Order by filling out the «Order Form (form)». Personal data, the address of delivery of the Goods, the e-mail address, contact phone numbers should be indicated without errors and abbreviations.
The Seller is not responsible for the content and authenticity of the information provided by the Buyer when completing the Order, including for personal data specified by him.
3.3. At the same time, the Buyer determines the method of delivery of the goods:
— receipt of the goods in person at the store at the address of the Seller,
— by the transport company to the terminal or to the house — at the place of residence (location) of the Buyer,

FREE Worldwide Shipping

All packages shipped out will be via a trackable method. Once our shipping company forwards the tracking number to us, we will in turn send you the tracking number via email. Please see below for the estimated shipping times to your country/region.

Estimated shipping times:

 United States, Malaysia, India, Thailand  ~ 7 to 20 business days.

Important note: Please note that all estimated shipping times stated are based on normal conditions. Every once in a while, we do experience heavy international shipping volumes, especially during the holiday seasons. Also, do note that customs in some countries do take longer times to clear and scan incoming packages, which explains for the difference in the estimated shipping times stated above.

 

Express Shipping by DHL, FedEx, Aramex, UPS or equivalent (6-13 days):

For enquiries on upgrading your order to express shipping, please send us an email at my.store.mood@gmail.com immediately after placing your order with us and we’ll respond to you with a quote and invoice for online payment. Do note that shipping by the express method costs about US$30-$50 per item, depending on the country it is being shipped to.

 

Order Processing times:

Please note that Order processing time must be added on to shipping times, to get the total time taken for you to receive an order upon placing it. Order processing time is between 4-6 business days, and is used to check your order for quality assurance, packing, printing of shipping labels, and forwarding it to our shipping company for dispatch.

 

Order cancellations

We will not be able to cancel orders once it has begun to be processed. As a general rule of thumb, if you do not email us within 5 hours of placing an order, there is a high chance that we will not be able to cancel it. Nonetheless, do drop us an email at my.store.mood@gmail.com as soon as possible if you would like to cancel your order.

 

Orders that are unable to be delivered

All packages that are refused, unclaimed from the local post office, undeliverable as addressed because you input the wrong name or address when you placed your order, will not be our responsibility. We reserve the right to charge a restocking and shipping fee of 30-50% of an item’s value if that happens. So please do remember to check your address carefully when you place an order. 🙂

  

Separate packages

If your received package seems to be missing any items, please do not worry! We do ship orders in multiple/separate packages every now and then, due to weight restrictions and also to facilitate faster shipping once an item is located in our warehouse.
